Information about personal data processing in accordance with GDPR

With due care for the protection of our Customers' personal data and in compliance with legal obligations, we inform you that since May 25, 2018, Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) [hereinafter: GDPR] applies.

In connection with this, the Customer is entitled to certain rights related to our processing of the Customer's personal data.

In accordance with GDPR, to ensure proper protection of personal data, the data subject must be provided with information regarding the processing of their personal data as specified in Article 13 or 14 of GDPR - depending on whether the data was obtained directly from the data subject or from other sources. Therefore:

1. Personal Data

Personal data is information relating to an identified or identifiable natural person. This primarily refers to data that enables identification of the Customer - e.g., name and surname, numerical identification data such as: PESEL, NIP, REGON, address and contact details e.g., telephone number, email address.

2. Data Controller

The controller of the Customer's personal data is Emmano sp. z o.o., address: Poprzeczna 7, 48-340 Głuchołazy.

The Customer may contact us on all matters relating to the processing of the Customer's personal data and the rights to which the Customer is entitled:

3. Purposes of Data Processing

The Customer's personal data may be processed by us for the following purposes, based on the legitimate interest pursued by the controller (Article 6(1)(f) GDPR):

  • fulfillment of orders placed by the Customer,
  • responding to inquiries submitted by the Customer,
  • handling Customer complaints and requests,
  • quality assessment of our services, i.e., satisfaction evaluation of contract performance.

We may also process Customer data for the following purposes:

  • Marketing - in particular, to present the Customer with offers related to their preferences regarding our services, if the Customer has given us voluntary consent; the legal basis for processing is therefore the Customer's consent (Article 6(1)(a) GDPR),
  • Contract performance - taking actions prior to contract conclusion or when necessary for the conclusion and performance of the contract with the Customer (Article 6(1)(b) GDPR).

Additionally, legal provisions require us to process Customer data for the purpose of exercising rights and obligations related to our business activities, including for tax and accounting purposes (Article 6(1)(c) GDPR).

4. Data Processing Period

The period for which we process the Customer's personal data depends on the purpose of processing. It usually results from:

  • the duration of the contract - not only the fulfillment of the Customer's order but also warranty and guarantee periods,
  • the limitation period for claims arising from the concluded contract, and also
  • requirements of generally applicable law (e.g., obligation to maintain inquiry registers, obligation to store accounting documents).

If the Customer has consented to the processing of personal data, e.g., for product and service marketing purposes, the Customer's personal data will be processed until the consent is withdrawn.

5. Data Sharing

Customer data is not only administered but also processed by us, which means it may also be shared with entities supporting our activities, such as:

  • telecommunications operators,
  • IT companies handling our technical infrastructure (hosting, email),
  • postal and courier service providers,
  • accounting and bookkeeping service providers.

In the above cases, we assure the Customer that the aforementioned companies will only have access to data to the extent necessary to achieve the main purpose.

6. Voluntary Provision of Data

Providing personal data by the Customer is voluntary. To the extent that the processing of the Customer's personal data takes place for the purpose of concluding and performing the sales contract, the consequence of not providing them will be the inability to conclude and perform the contract.

7. Customer Rights

In our activities, we guarantee the possibility of exercising rights under GDPR. According to GDPR, the Customer has the right to:

  • Receive information about our processing of Customer's personal data and a copy thereof,
  • Data portability of personal data provided by the Customer in connection with the contract or processed by us based on Customer's consent,
  • Object to data processing (request to stop processing personal data), especially for reasons related to the Customer's particular situation.

The Customer may also request:

  • Rectification of their data if we have incorrect, e.g., outdated or incomplete data,
  • Erasure of Customer's personal data ("right to be forgotten"),
  • Restriction of processing of their personal data.

If the Customer wishes to exercise the above rights, they may submit their request via:

  • email to: klient@emmano.pl
  • traditional mail to: Emmano sp. z o.o., Poprzeczna 7, 48-340 Głuchołazy

The Customer also has the right to lodge a complaint with a supervisory authority dealing with personal data protection, i.e., the President of the Personal Data Protection Office.
